Information on the Applicant / Member of the consortium Information on the Applicant/Member of the Bidding Consortium Submission of a document showing the bidder's complete information. In the case of a bidding consortium, each member must submit the relevant information. The information includes in particular: full name, legal representatives, full address, internet address, contact person incl. telephone number and e-mail address. Please use the provided form A1. The application as a bidding consortium is admitted. A bidding consortium is treated like an individual applicant (Section 50 § 2 SektVO). If applicants are addressed in the tender documents, this also refers to the joint form of participation of a bidding consortium. In this respect, regulations which specifically are related to bidding consortia, exclusively use the term "Bidding Consortium." The bidding consortium shall nominate an authorized representative for the conclusion and implementation of the contract and who signs form A1. The authorized representative shall be available to the contracting entity as the contact person of the bidding consortium in this tendering procedure. Members of the bidding consortium shall jointly complete the form "Statement of Bidding Consortium", which also names the authorized representative.

Insurance broker license / Compliance with IDD Directive 2016/97/EU) The applicant is a registered insurance broker and licenced to operate in both The Netherlands and Germany and confirms its compliance to all requirements of Directive (EU) 2016/97 on Insurance Distribution (IDD) as transposed into national law. Therefore insurance broker must hold a valid insurance intermediary licence in Germany (§34d GewO), the Netherlands (Wft – Wet op het financieel toezicht) or a comparable European licence. The applicant confirms that it is authorized to provide the requested services for the contracting authority’s entities in Germany and the Netherlands. Please provide a license to operate as insurance broker.

Extract of commercial register Please provide a proof of registration in a commercial register of the relevant authority of the country in which the company is established (E.g. Kamer van Koophandel (NL), Handelsregister (DE), Companies house (UK)) , which may not be older than twelve months at the expiry of the call for competition period. Note regarding the formation of a consortium: In the case of a consortium, proof must be provided by each member of the applicant group.

Professional Indemnity / Liability Insurance Insurance with a minimum coverage of EUR 5,000,000.00 is required if the contract is awarded. The bidder has two options for demonstrating compliance in this area: Option 1: The bidder has already taken out insurance with the required coverage amounts. Proof is provided by uploading a corresponding insurance confirmation. Option 2: The bidder has not yet taken out insurance with the required coverage amounts. However, the bidder undertakes to take out insurance with the required coverage amounts immediately upon being awarded the contract, to maintain it for the duration of the contract term, and to submit a corresponding certificate unsolicited at the start of the contract term. As security, the bidder shall, to the extent possible, provide a letter of intent from their insurer confirming that the insurer will provide the required insurance and coverage (in the event the bid is awarded). The letter of intent must be uploaded. Note on the formation of a consortium: In the case of a bidder consortium, at least one member of the consortium must meet the respective insurance requirements. Please upload proof of insurance coverage.

Self-declaration of no grounds for exclusion Note from the Contracting Authority: Economic operators interested in the contract must declare whether any grounds for exclusion apply to them. Furthermore, there is no confirmation from the insolvency administrator regarding the legally binding confirmation of an insolvency plan (Section 258 InsO); ☐ The company is not in liquidation.

Self-Declaration Regarding the "Russia Sanctions Package" / Article 5k (3) of Council Regulation (EU) 2022/576 of 8 April 2022 1. The bidder is familiar with Regulation (EU) No 833/2014, as amended by Regulation (EU) 2022/576. This Regulation imposes, among other things, sanctions against Russia, Russian companies, Russian nationals, or natural or legal persons established in Russia, as well as products and materials originating in Russia. 2. The bidder is not one of the persons or companies associated with Russia within the meaning of Article 5(k)(1) of Regulation (EU) 2014/833, as amended by Article 1(23) of Council Regulation (EU) 2022/576 of April 8, 2022, concerning restrictive measures in view of Russia’s actions destabilizing the situation in Ukraine: The bidder is not a Russian national or a natural or legal person, organization, or entity established in Russia No more than 50% of the bidder’s ownership rights/shares are directly or indirectly held by a Russian national or a natural or legal person established in Russia, or by a company to which any of the criteria under letter a) apply The bidder is not acting on behalf of or at the direction of persons or entities to which the criteria in subparagraphs (a) and/or (b) apply. 3. The persons or companies involved in the contract as subcontractors, suppliers, or companies, and whose services account for more than 10% of the contract value, also do not belong to the group of persons referred to in this declaration or have a connection to Russia within the meaning of this declaration. 4. The bidder confirms and ensures that, even during the term of the contract, no subcontractors, suppliers, or companies will be engaged whose services account for more than 10% of the contract value and who do not belong to the group of persons/companies specified in No. 3 of this declaration. The bidder agrees that if it is determined (at a later date) that incorrect and/or incomplete information was provided, the bidder may be excluded from further participation in the tender procedure and/or any agreement (possibly) already concluded for this reason may be rescinded or terminated without financial consequences for TenneT.

Acceptance of TenneT General terms and conditions of purchase General Terms and Conditions of Purchase (GTCP) and Special Terms of Purchase Order for Services of TenneT TSO GmbH form the basis of this request for proposals and will become part of the contract after the bid is awarded. References As part of the request to participate, the applicant confirms that it has at least two suitable references demonstrating the provision of services comparable in nature (comparable insurance lines) and complexity (multinational insurance programs; multi line insurance portfolios) to the respective lot(s) applied for. Upon written request from the contracting entity the applicant has to show and submit referenced projects in written within 5 calendar days. The references must specifically relate to the lot(s) and insurance lines for which the applicant submits its application. The use of the same reference for more than one lot is permitted, provided that the comparability of services is ensured for each respective lot. The reference documentation shall include at least the following information: Client (including contact person, if available), Description of the services provided, description of insurances covered; Period of performance, Contract value or qualitative indication of scope, Indication of the respective lot and/or explanation of comparability. Minimum requirements on reference for Lot 1 and 2: Lot 1 and Lot 2 insurance broker must provide evidence of placing comparable insurance programmes for European energy or infrastructure clients or mutlnational corporations in the past 5 years. Lot 1: at least one reference relates to an onshore CAR or PD insurance programme with a minimum sum insured of 100m EUR. Lot 2: at least one reference relates to an offshore CAR or PD insurance programme with a minimum sum insured of 500m EUR. Applicant confirms, that suitable references are available upon request.
